Why do we inform you?
TOP knows that you care how information about you is processed. Also, TOP has an obligation under the Personal Data Protection Act B.E. 2562 (2019) (“PDPA”) to inform you on how we process your personal data. This Notice outlines how we collect, use, and disclose (collectively “process”) your personal data.
“Personal data” means any information relating to a natural person (“Person”), which can identify such Person, directly or indirectly. Personal data does not include the information of deceased Persons. Common examples of personal data processed by TOP in its day to day running of the business include: names, addresses, and contact details.
Who is the data controller?
The data controller is TOP. This means that we make the decisions regarding processing of your personal data and also have the duty to do this appropriately.

How and why do we process your personal data?
The personal data we collect from you and/or through our systems helps us manage the employment and contractual relationship with you.
The personal data we collect, the basis of processing and the purposes of processing are detailed below. Sometimes, these activities are carried out by third parties (see “Does TOP share personal data with others?” below).
We encourage you to supply only the information you are comfortable with and/or that is required for us to execute on our business relationship with you. In particular, care should be taken when you share special categories of personal data with us. Special categories of personal data could include: racial, ethnic origin, political opinions, cult, religious or philosophical beliefs, sexual behavior, criminal records, health data, disability, trade union information, genetic data, biometric data.

Does TOP share personal data with others?
Service Providers
On the occasion that your personal data will, where applicable, be processed by the service provider on TOP’s behalf.
We will check any third party that we use to ensure that they can provide sufficient guarantees regarding the confidentiality and security of your data. We will have written contracts with them which provide assurances regarding the protections that they will give to your data and their compliance with our data security standards and international transfer restrictions.
Does TOP transfer personal data to countries outside Thailand?
Your personal data will not be transferred to a foreign country/international organizations located therein (the “Foreign Organizations”).
How long does TOP store your personal data?
Personal information is collected during the recruitment process. After the recruitment process is done, TOP further retains your personal data for 1 year in case there is a relevant job offering for which you will be a fitting candidate in the future.
What are your rights under the PDPA?
You have the right to request access to or obtain a copy of, receive, correct, erase, destroy or anonymize, or restrict of the use of, your personal data. You are also entitled to object to the processing of your personal data in certain instances. When we process your personal data based on your consent, you may withdraw it for the future at any time. Please note that where your personal data must be provided to us, the possible consequences of failing to do so need to be considered (see “Is there a case where your personal data must be provided?” in the section “Processing of your personal data” above).

If you consider that we, including our employees or contractors, violate or do not comply with the PDPA, you may file a complaint with the Office of the Personal Data Protection Committee, which is the supervisory authority of the data protection laws in Thailand.
Changes to this Notice
We may decide to change this Notice. If the change is fundamental or may significantly affect you, we will provide you with the updated Notice in advance of the change actually taking effect. We encourage you to review the content of this Notice regularly.
